Terms of Use

These Terms govern your use of the Skintel app, website, and related services. They are written to keep expectations clear while the product helps you understand your own skin patterns.

1. Agreement to these Terms

These Terms of Use (“Terms”) are a binding agreement between you and CodesWhat, operator of Skintel (“Skintel,” “we,” “us,” or “our”). They apply to the Skintel iOS application, skintel.app, and related services (together, the “Service”).

By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you use Skintel on behalf of an organization, you represent that you have authority to bind that organization.

Important

Skintel is a cosmetic wellness and tracking tool. It is not a medical device, healthcare provider, or emergency service and does not provide medical advice or diagnosis.

2. Eligibility and accounts

You must be at least 18 years old and legally able to enter into this agreement to use Skintel. The Service is not intended for children or teens.

You agree to provide accurate account information, keep sign-in credentials secure, and promptly notify us of suspected unauthorized access. You are responsible for activity on your account unless caused by our failure to use reasonable security. You may not transfer, sell, or share your account with another person.

Some features require device permissions, including camera, photos, HealthKit, or location. You choose whether to grant those permissions and can change them in iOS Settings, although some features will not work without them.

3. Skintel is not medical care

Skintel provides informational, educational, and cosmetic-wellness features. Scores, trends, correlations, ingredient flags, and recommendations are not medical advice and are not intended to diagnose, treat, cure, or prevent disease or any health condition.

  • Do not rely on Skintel for an emergency or urgent health concern.
  • Do not delay or disregard professional medical advice because of information from Skintel.
  • Consult a qualified clinician for persistent, severe, painful, rapidly changing, or otherwise concerning skin symptoms.
  • Ingredient flags related to pregnancy, breastfeeding, allergies, or sensitivity are general prompts to check with an appropriate professional, not safety guarantees.

If you believe you are experiencing an emergency, contact local emergency services. Skintel does not monitor your account for emergencies and cannot contact a clinician on your behalf.

4. AI and measurement limitations

Skintel uses automated systems, statistical methods, and artificial intelligence to analyze photos and other information. Results may be inaccurate, incomplete, inconsistent, delayed, or affected by lighting, camera position, makeup, device quality, skin tone, and limited history.

Skin scores and correlations are primarily useful for comparing your own entries over time; they are not clinical measurements and should not be compared across people. A correlation does not prove that a product, behavior, food, environment, or health factor caused a change. You are responsible for using judgment before changing a routine or acting on an automated suggestion.

We may update models, scoring methods, and explanations. This can change current or historical results. Where offered, reanalysis may produce a different score without any change in your underlying photo.

5. Your content and permissions

“Your Content” includes photos, profile information, product lists, journal entries, feedback, and other information you submit. As between you and Skintel, you retain the rights you have in Your Content.

You grant us a limited, worldwide, non-exclusive license to host, copy, process, transmit, display to you, and create derived measurements from Your Content only as needed to operate, secure, support, and improve the Service as described in the Privacy Policy. This license ends when Your Content is deleted, except for temporary backups, information we must retain by law, and properly de-identified information.

This license does not itself authorize us to use identifiable facial photos for model training. That use requires a separate affirmative opt-in. You represent that you have the necessary rights to submit Your Content and that it does not violate another person’s privacy, publicity, intellectual-property, or other rights. Do not upload another person’s face or health information without lawful authorization.

Privacy and sensitive data

Our Privacy Policy explains how we handle facial images, derived metrics, HealthKit data, location context, and other sensitive information. Required biometric or health-data consent will be presented separately from these Terms.

6. Free and paid features

Skintel may offer free features, trials, one-time purchases, and automatically renewing subscriptions. Prices, billing periods, trial terms, and included features will be shown before purchase. We may change future pricing or feature packaging, but changes to an existing subscription take effect only as permitted by Apple and applicable law.

Purchases made in the iOS app are processed by Apple and are subject to Apple’s purchase, subscription, cancellation, and refund terms. Unless Apple states otherwise, subscriptions automatically renew until canceled through your Apple account settings at least 24 hours before the end of the current billing period.

Deleting your Skintel account does not automatically cancel a subscription billed by Apple. You should cancel the subscription separately in Apple’s subscription settings. Deleting the app also does not cancel a subscription.

7. Acceptable use

You may not:

  • Use the Service unlawfully, fraudulently, or to harm another person.
  • Upload content you do not have the right to submit.
  • Attempt to identify another person, perform facial recognition, or infer sensitive traits about someone else using Skintel.
  • Probe, scan, disrupt, overload, bypass, or defeat security, access controls, usage limits, or payment controls.
  • Scrape, harvest, or use automated means to access the Service except through an interface we expressly provide.
  • Reverse engineer, copy, resell, sublicense, or create a competing service from protected parts of Skintel except where applicable law expressly permits it.
  • Use output to make clinical claims or represent Skintel as medical advice.
  • Introduce malware or interfere with another user’s access or privacy.

We may investigate suspected misuse and cooperate with lawful requests. We may apply fair use limits to protect availability, inference costs, and other users.

8. Skintel ownership and feedback

The Service—including its software, design, branding, text, models, scoring systems, databases, and non-user content—is owned by CodesWhat or its licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose.

If you send ideas or feedback, you allow us to use them without restriction or payment. We will not treat feedback as confidential unless we agree otherwise in writing. Feedback does not include your facial photos, health data, or other personal information, which remains governed by the Privacy Policy.

Third-party services

Skintel relies on third-party platforms and services, including Apple, authentication, cloud infrastructure, weather, and analysis providers. Their separate terms may apply to your direct relationship with them. We are not responsible for third-party services outside our control, but we remain responsible for our own data-processing obligations.

9. Changes, suspension, and termination

We may add, remove, or change features; discontinue beta functionality; or suspend the Service for maintenance, security, legal, or operational reasons. We will provide notice when reasonably practical if a material change adversely affects paid features.

You may stop using Skintel at any time and may request account deletion through account settings. We may suspend or terminate access if you materially violate these Terms, create risk or legal exposure, fail to pay applicable fees, or misuse the Service. When reasonable, we will provide notice and an opportunity to appeal.

Provisions that by their nature should survive termination—including ownership, disclaimers, limitations of liability, and accrued payment obligations—will survive.

10. Disclaimers and limitation of liability

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that results will be accurate, available, secure, or error-free. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

To the maximum extent permitted by law, CodesWhat and its affiliates, officers, employees, and suppliers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of data, profits, goodwill, or business; or harm resulting from reliance on automated outputs, even if advised that such harm was possible.

To the maximum extent permitted by law, our total liability arising out of the Service or these Terms will not exceed the greater of (a) the amount you paid Skintel during the 12 months before the event giving rise to the claim or (b) US $100. These limits do not apply where prohibited, including liability that cannot be limited for fraud, intentional misconduct, or certain personal injury.

Applicable law

These Terms are governed by applicable law, without limiting mandatory consumer protections available where you live. Before starting a formal dispute, you and Skintel agree to make a good-faith effort to resolve it by contacting the other party. Nothing here prevents either party from seeking urgent injunctive relief or using a legally available small-claims process.

11. Updates and contact

We may update these Terms. If a change is material, we will provide reasonable notice and, where required, ask you to accept the revised Terms. The effective date above identifies the current version. Continued use after a non-material update becomes effective means you accept the revised Terms.
